In 1973 the SOS for Wales had granted F`s predecessors in title planning permission for extraction of minerals from a site in an area of outstanding natural beauty subject to 11 conditions including a prescribed starting date on or before 30 November 1978. F were still waiting for the local planning authority to approve their plan by November 1978. On 2 November, F appealed to the SoS so that work could commence by the 30 November. The Inspector conducting the planning appeal decided that F had no choice but to commence extraction work on the site. Limited workings ceased on 8 December 1978. On 29 November 1979 F made an application for renewal of planning permission which was refused on 7 February 1979. F continued to make representations to the SoS, who granted planning permission in May 1982. Work commenced on 5 September 1983 in accordance with the 1982 approved scheme.
