Upheld the QBD decision that the Wildlife and Countryside Act 1981 s28 was not directed at an owner or occupier of part of land within a site of special scientific interest when the occupier was carrying out specified works on some other part of the SSSI not owned or occupied by him. Therefore, as the water authority was entering the land only for a short time to carry out the prescribed operation of draining a ditch, he was therefore not the owner according to the terms of s28 of the 1981 Act.
