Decision made following an application under Landlord and Tenant Act 1987 s13 by the applicant, D, the nominated person within the meaning of that section, for the determination of the price to be paid for to the respondent, S, for the premises in question and to settle the terms of the conveyance consequent on the service on S of a purchase note dated June 1991, under s12 of the Act on behalf of the lessees of seven flats within the premises. S had purchased the premises at auction in 1990 subject to and with the benefit of existing leases and subject to a number of special conditions of sale. These included that any arrears due at that time should be paid by S to the vendor and recovered later from tenants. S claimed the true purchase price of the property was £13,389 ie the sum of £4,500 paid at auction and £8,889 paid as rent arrears. D disputed this and claimed the correct amount which he had offered to S was £2,2720 representing 8 years` purchase of the total
