In an action for possession by the plaintiffs (S), as owners of a lease reversion, the assignees (B) paid the claimed arrears of rent plus the fixed costs of proceedings to avert loss of their tenancy, but only after being debarred from defence by counterclaim. The extra costs, though, arising from the disputed counterclaim were not included. S failed in a lower court to recover these but succeeded at the Court of Appeal.
