Questions arose between the parties in respect of the refusal by B to allocate M a quantity of milk quota under the system of additional quota on the grounds that he had let his holding and was therefore not in a position to produce on his holding the amount of milk required. The court held that the regulations only covered a farmer who was responsible for the operation of all relevant production units. If the holding was let those conditions were satisified only by the lessee. The owner had therfore forfieted the right to an allocation of a specific milk quota.
