The premises were originally let to the `Minister of Works` by a lease dated 5 May 1949 granted for 42 years from 29 September 1947 at a fixed rent of £1,150 with full repairing lease. Clauses 6 and 15 contain unusual tenant`s covenants as to user and assignments. After considering relevant case law relating to `cushion` deduction under s24A(3) of the 1954 Act decided that such a deduction was not applicable. Interim rent fixed at £79,400 pa.
