520 _aChD 10 April 1992. In 1987 L.Ltd transferred the title absolute on part of its land to LB together with the easements and other rights as specified in a schedule to the transfer. In 1988 W.Ltd succeeded L.Ltd as registered proprietor. LB gave notice to W.Ltd that it sought to exercise the scheduled rights in respect of the leasehold land. Later in 1988 W.Ltd transferred the leasehold land to the defendants (LR) and LB`s purchase of the leasehold land was completed in 1989. LB claimed for a declaration that they and their successors in title were entitled to the benefit of the easements specified in the 1987 schedule. It was "held" that since the retained land had been transferred to a third party before all conditions in the schedule were satisfied LB`s claim failed.
