The rent was determined, based on the following: (1) the tenants dimensions were accepted because the landlord had not produced information to enable its calculations of area in terms of zone A to be checked and had not sought to correct the tenant`s dimensions; (2) space occupied by toilets must be included notwithstanding the RICS Code of Measuring Practice; (3) there should be an addition for return frontage, but it could not be a regular 10% for that was arithmetical and the additon should depend on the shop`s position and the length of the return display, and 5% was sufficient; (4) after making necessary adjustments to each comparable, the zone A prices indicated for the subject premises ranged from £42psf to £47psf and the tribunal arrived at £45psf.
