520 _aCA 16 September 1992. Fullfilling responsibilities under Housing Act 1985 pt III, the landlord T provided A with temporary accommodation to relieve homelessness. After A`s refusal of a permenant dwelling in March 1991, T served notice to quit. A declined to leave; T commenced possession proceedings. At issue were whether A`s tenancy was protected under Schedule 1, paragraph 6 of the Act, and whether the defence offered could be allowed as it offered a) no reasonable cause of action or b) it was abusive. Application dismissed at first instance, but T`s appeal was subsequently granted; notice to quit was considered sufficient to conclude A`s contractual rights.
