520 _a`Section 137` is an example of a legal provision which has acquired a distinct meaning without having been considered in the courts. Similarly, s2(4)(iii) of the Land Charges Act 1972 has not come under judicial scrutiny in relation to dealings with equitable interests. This article questions the validity of linking these two provisions in the manner expressed by the "Law Commission working paper on mortgages".
