520 _a13D 21 February 1992. The Planning Board failed to determine an application for outline planning permission for partial demolition and conversion of farm buildings for residential use. The applicant, T, appealed. In its representations the board referred to the draft Local Plan which layed out their thinking on housing within the National Park. Reference was also made to the structure plan. T responded that little weight should be given to Local Plan as it needed to be modified to conform to the structure plan. The appeal was dismissed. T applied to the High Court under Town and Country Planning Act 1990 s288 on three points, that the Inspector had taken into account the draft local plan, that he had given too much weight to the structure plan policy and that he had taken into account another appeal before the SoS and that these three factors had vitiated the decision. The application was dismissed.
