Mr and Mrs Stoddart applied to the Lands Tribunal for Scotland in terms of s 1 of the Conveyancing and Feudal Reform (Scotland) Act 1970, for the discharge of land obligations affecting their property. The consent of neighbouring proprietors was required if buildings on the feu were to be altered. Six of the neighbours objected to the application. On 31 March 1992 the Tribunal pronounced an order refusing the application.
