| 520 | _aCA 30 October 1992. Appeal by A against a CC decision granting a possession order to S. A, a tenant by assignment whose contractual lease expired on 29 September 1987 remained in possession under a continuation tenancy under Landlord and Tenant Act 1954 Part II. S served notice under s25 of the 1954 Act terminating the tenancy stating that grant of a new tenancy would be opposed on grounds of persistent delay in paying rent. A served a counternotice. Both parties continued to negotiate a new lease through solicitors with correspondence marked `subject to contract` and `subject to lease`. A`s solicitor failed to apply to the Court for a new lease. Use of the terms `subject to contract` and `contract to lease` did not mean that A could rely on S agreeing to a new lease. Appeal dismissed, | ||
