520 _aChD 16 October 1992. Hearing of an originating summons by L to determine the validity of a notice London Building Acts (Amendment) Act 1939 s47, served on behalf of H. At issue was whether notice given on behalf of one joint tenant only, was valid. L questioned the validity of the notice arguing that it should have been given on behalf of H and his wife as joint tenants, and not on behalf of H alone. Held, the notice was invalid. H and his wife would constitute the "building owner" under the 1939 Act for the purpose of serving a notice under s47.
