520 _aCA 3 November 1992. The plaintiff (W) owned a site upon which stood a timber shed, the defendants (C) were owners of an adjoining property. C started building work and served notice on W under the London Building Acts (Amendment) Act 1939 of their intention to carry out work on the party wall. Prior to the commencement of the work the wall collapsed damaging the shed. W claimed for the cost of rebuilding the shed. C appealed against the claim. Appeal dismissed.
