520 _aORC 14 October 1992. T entered a JCT 80 contract to build a car sales centre for R and were paid for work completed under the interim certificate. T was not paid for the next stage before it went into receivership, although the second certificate had been issued a week previously. Not all the work had been finished satisfactorily and some materials supplied by T had been paid for. R, the defendant, did not pay for any of the additional work or make arrangements to complete the project, and claimed they were suffering loss. T sued successfully for the outstanding money covered by the second certificate, as well as for the materials.
