D had been unable, during the latter period, to promote a scheme of reconstruction. Eventually D brought an action for possession, offering alternative, though smaller, accommodation. B countered by claiming that the landlords had failed in their obligations to maintain the property. An order for possession was awarded to D. B appealed. Appeal dismissed as the hardship to B was less severe than the general detriment caused by failure to restore the historic building which would ensue if B remained.
