520 _aCA 22 February 1993. The defendant (P) and a Miss Doubtfire (D) held a joint secure tenancy from H which included a clause requiring four weeks` notice to quit be given. However, D unilaterally left, claiming violence by P, and wrote to H terminating her tenancy. P refused to leave and the court granted an order for possession. P appealed successfully; the case "Hammersmith and Fulham LBC" was disallowed as precedent as D`s letter was regarded not as a letter to quit but one operating a break clause.
