520 _aCA 30 October 1992. Following an inspector`s report, the SoS granted planning permission for David Wilson Homes (Southern) to build houses on a village site in Somerset. This was overturned by the respondent in the present action (S) who claimed that the inspector had misunderstood present and future development plan policies. The appellants (SoS) contested this decision at the CA asserting that the inspector had acted according to Town and Country Planning Act 1990 s70. Analysis of the decision letter showed no misunderstanding or oversight of relevant policies. Appeal upheld.
