520 _aIn Proberum Ltd v SOS for the Environment and Another QBD 9 October 1989 it was held that an inspector was wrong to dismiss an appeal against non-determination of approval for access because he had failed to deal with the legal submission that when the SOS granted outline planning permission for holiday homes it must have been implicitly appreciated that access was unsatisfactory and that it was wrong to canvass solutions to the problem which involved access over land not in control of the appellant.
