Claim by plaintiff tenant Dong Bang Minerva (UK) Ltd (X) for damages against defendant landlord Davina Ltd (Y) for breach of statutory duty under the Landlord and Tenant Act 1988. X applied to Y to sublet part of its premises but on failing to win Y`s consent instigated this action. Y alleged that as X had failed to give any undertaking to meet any costs involved. Y was in breach of its statutory duty under the 1988 Act and should have reasonably been expected to given its conditional consent to sublet by August 1993.
