Promotion led to a change in employment conditions, which required for the first time that E dwell in the cottage to better perform his duties. In 1990 E applied to buy the premises under Housing Act 1985 s118(1). This was challenged on the grounds that the renewed contract conditions invalidated the secure tenancy and thus the right to buy. Having lost his claim at the first hearing, E appealed asserting that C`s defence of Sch 1 para 2(1) was not applicable when the tenancy was first agreed. Appeal dismissed.
