520 _aCA 29 July 1994. R was granted a tenancy of a flat belonging to W for 6 months, in 1986 at £520 per month, regulated under the Rent Act 1977. Unknown to both parties, the premises were subject to a registered rent of £7.50 per week from January 1975. With effect from January 1990 the recoverable rent was reregistered by the rent officer at £200 a month and W sent R a letter enclosing notification. R commenced proceedings to recover overpayment of rent which W stated that under the Rent Act 1977 s57(3)(b) R was entitled to recover overpayment for a 2-year period only. W served notice under Landlord and Tenant Act 1987 s48 on R. Judge dismissed R's claim and allowed W`s counterclaim for arrears of rent. R appealed. Appeal dismissed.
