By a written agreement in October 1986, first defendant H granted (A) a five year option to purchase a piece of land at open market price registered as an estate contract under Land Charges Act 1972 s2(4) in March 1988. A wanted to instigate the option in October 1988 but H had contracted to sell part of the land to D, the sale of which was completed in January 1991. A issued a writ to enforce option. Held that a registration of the option was sufficient warning to a later potential purchaser ffrom the grantor of the option and additional registration was not required. D`s appeal dismissed.
