To determine whether the value of the C`s freehold interest in a dwelling house was depreciated as a result of a sewer pipe being laid in the back garden by Thames Water under statutory powers in Water Industry Act 1991 s12. C accepted £99.36 in respect of reinstatement work to the rear garden and £415 for right of entry, residential disturbance and their time without prejudice to their compensation claim. LT held that the presence of the sewer would not have detrimental effect on freehold value. Claim dismissed.
