520 _aDiscusses the decision in Smith v Eric S Bush, where the defendant firm of surveyors was held liable in negligence to the plaintiff housebuyer in respect of a mortgage valuation and report performed on behalf of the Abbey National Building Society. The cc awarded damages to the housebuyer. The defendants appealed to the CA, see Abstract 37725, relying on disclaimers in the mortgage application form. The appeal was dismissed. The appeal was fought on fairly narrow ground but gives rise to wider issues which the author examines such as scope of a person`s professional duty of care , measure of damages , disclaimers and the Unfair Contract Terms Act 1977 .
