After the 23rd payment the engineer accepted the contractors` revised calculations and the contractors increased their claims on the grounds that the earlier claims had been incorrect. The arbitrator subsequently agreed and awarded interest on the excess due to the contractors. This award was disputed by B on the grounds that the interest was not claimed when it became due. The decision in "SoS Transport v Birse-Farr Joint Venture" 1993 followed. | ||
