DTp duly took possession of part of the carpark in March 1990. Meanwhile G had lodged a compensation claim for the land and injurious affection. In dealing with preliminary issues the LT ruled on the extent of land compulsorily purchased and found that G had not given notice before March 1990 of any intention to apply for a determination under the Compulsory Purchase Act 1965 s8.
