The plaintiff council (B) had let a garage business to Mr L`Heureaux who then converted a portion of the premises into a residential flat and sub-let it to Mr Paice, in breach of the convenant made with B. P appealed against the decision that when the mesne landlord surrendered his tenancy P was not entitled to a secure tenancy as a direct council tenant. Appeal allowed.
