There was an existing second charge on matrimonial home to secure husband`s office premises. Solicitor asked bank whether they required new charge. Bank asked solicitor to act on their behalf and advise wife. Debts were not repaid, a possession order taken out on husband and wife. Wife appealed, that solicitor acted as agent to the bank. Appeal dismissed.
