L`s requests for further designs and costings delayed concluding the contract until falling market values persuaded R that to continue would be uneconomic. R withdrew, with the site undeveloped, and brought an action for the restitution of professional fees incurred in preparing for the scheme. "Held" that if the contractual parties are expressly free to withdraw, than all costs arising from the proposed scheme are the individual parties` risk until the contract is signed.
