520 _aLVT 9 April 1997. Following the CA ruling that the purchase notice served by tenants under the Landlord and Tenant Act 1987 was valid, several issues were referred to the LVT for determination. Firstly, consideration must be increased under s12(6) of 1987 Act to include vacant possession value of the flat; secondly the nominee purchaser was allowed to acquire freehold of houses attached to property comprising of flats; thirdly confirmed the tenants` rights to use gardens and amenity land but not subject to termination and fourthly transfer required payment of consideration to respondent`s bank on confirmation that bank had charge over property.
