It obtained tenders from subcontractors for a shelving system, inviting tenderers to submit three distinct bids; one for design, one for supply amd installation as a subcontractor under the main contract, and one for on-going maintenance. R`s bid was accepted on conditions that if the supply contract failed to materialise then there would be no penalty for N. R could not agree a suitable programme for the supply and installation of the system with the main contractor who subsequently placed the subcontract with another. R`s action against N was dismissed.
