520 _aCA 20 February 1997. Purchaser S and vendor U entered into a contract for the sale of registered land. At the time U was not the registered proprietor but was entitled to purchase the land. U later notified S of its subsequent purchase, sent answers to his requisitions and returned the draft transfer, giving notice to complete. Two days before the agreed competion date S rejected the notice on grounds that he had not received copy entries that U was the registered proprietor of the land. U claimed S had accepted title by the National Conditions of Sale 9(6) and request for copy entries was made too late. S did not complete on the said date and U was granted that S had rescinded the contract and was entitled to forfeit the deposit. S`s appeal dismissed.
