In April 1982 H served notice to treat and intention to enter, subsequently taking possession. In response A served a notice of claim. The claim in response to works carried out by H was received in January 1992 and rejected. In October 1993 a further claim was turned down. In September 1995 A made reference to the LT who declined jurisdiction to decide whether the claim was statute-barred by the Limitation Act 1980 s9. "Held" limitation period expired.
