520 _aLT 24 April 1997. Powys CC built a primary school in the vicinity of the claimant`s dwelling-house. The claimant wants compensation under the Land Compensation Act 1973 Part 1 in respect of the depreciation in value of their property. A preliminary issue of law was ordered to be heard as to whether compensation is payable under Part 1 of the Act in circumstances where the value of interest in land is depreciated by physical factors caused by the use of a primary school provided and used by the local education authority. Land Compensation Act 1973 s1(6) protects any public works from nuisance action. A claim for compensation could not be maintained.
