520 _aCA 15 May 1997. Plaintiff landlords let to the defendants an agricultural holding which included a dwelling house. The landlords served a notice to quit under the Agricultural Holdings Act 1986, after the tenants failed to comply with a notice to pay rent. The tenants contended that the notice was invalid because it failed to comply with Protection from Eviction Act 1977 s5. The CC held that where primarily agricultural premises are let containing a dwelling-house, the premises are let as a dwelling within the meaning of s5 of the 1977 Act. The landlords appealed. Appeal allowed as the premises were let as an agricultural holding and not as a dwelling.
