520 _aORC 28 July 1987 Appeal from an arbitration on a number of issues relating to a residential development in Bromley, under JCT 1963 with quantities (1977 edition). The questions of law raised were 1) whether on a true construction of clause 3 13 4 of the contract bills, the contractor should provide a programme for the whole of the works showing a completion date no later than the Date for Completion; 2) whether on a true construction of JCT 1963 clause 21 and clause 3 13 4 of the contract bills and so far as the programme showed a completion date before the date of completion, was the contractor entitled to carry out the works in accordance with his programme and so complete early and 3) was there an implied term in the contract to the effect that the employer and his architect should carry out their obligations so as to enable the contracto to complete early as he had planned. Held that the programme clause was a contract provision and in the light of the wording of JCT 1963 clause
