520 _a"Broadwater Court Management Co Ltd v Jackson-Mann" CA 23 October 1997. J refused to pay service charges and counterclaimed for breach of covenant and repair. At issue was whether B entitle to include in service charges items of an administrative nature. B sought damages calculated by reference to the diminution in the value of the defendant`s flat. Judge found B entitled to £25 a month for loss of amenity. B appealed. Appeal allowed in part.
