520 _aCA 15 May 1997. National Trust (NT) let a landholding (agricultural) on an annual tenancy to Knipe (K). The tenancy was protected by the Agricultural Holdings Act 1986. NT served notice to quit after a notice to pay rent (under 1986 Act) in arrears, was ignored. K did not challenge notice. NT issued proceedings to recover possession. Recorder dismissed NT`s claim. NT appealed. Held that dwelling was an agricultural holding, not let as a dwelling, therefore the Protection from Eviction Act 1977 s5 did not apply. Appeal allowed.
