The adjacent unit was later let to a pawnbroker who erected a sign that restricted light and attracted customers who had little money to spend and waited outside D`s shop. D witheld rent and disclaimed the lease, claiming that the landlords had derogated from their grant by failing to control the nuisance. C, the mortgagees in possession, claimed arrears for rent and an order to comply with a keep open covenant. Their appeal against an earlier ruling was also dismissed.
