520 _aLT 30 May 1997. The claimants (B) sought compensation under Land Compensation Act 1973 pt 1 following construction of a sewage outlet adjacent to their dwelling. B gave evidence of smell during maintenance and inspection of the sewer outlet. There was also a smell from the outlet after rainfall. B felt inhibited in inviting guests to their home and in the use of the garden because of the odour. B believed that the value of their property was reduced by 7.5 per cent by the sewer outlet. The water company did not think that B would be capable of knowing whether any smell came from the sewer outlet or the sewage works lying to the south of the property. Held, compensation payable by the water company to B.
