520 _aCA 16 July 1997. The appellant landlord (J) let a flat to the respondent tenant (K) for a term of six months. On finding herself unable to pay the rent K orally gave J four weeks` notice to quit. J then advertised the flat and showed an prospective tenant arround with K`s consent. J wrote to K stating that as she had not paid the last two weeks` rent K should leave the flat that day. Following a visit to the flat by J, K left and J took possession on 5 May 1994. The court ordered J to pay damages for unlawful eviction under the Housing Act 1988 ss27 & 28. J appealed that as K had agreed to leave the flat by 12 May the damages should be £1,500 rather than the £11,000 ordered by the court. Appeal allowed.
