M broke her leg after tripping on one of the footpaths. M brought an action for damages for personal injury. Action dismissed, an appeal was also dismissed. The appeal to HL concerned whether any duty of care is owed by the owner of soil over which a public right of way passes towards any person using it. Appeal dismissed.
