520 _aCA 19 March 1987 Appeal from a High Court decision (See Abstract 37311) preventing tenants from exercising an option to renew their lease because of breach es of both positive and negative covenants . These breaches were spent at the date the option was exercised. CA held that spent breaches whether of negative or positive covenants, will not destroy the tenants` option for a further lease. It is only subsisting breaches of covenant that would destroy the tenants` rights.
