The committee considered eight open market value comparables, two of which provided comparable accommodation to the flat, and arrived at a fair rent after adjusting a fair rent comparable. The appellant appealed against the decision. The committee conceded that its decision should be quashed. The decison was quashed and remitted for reconsideration on the basis that a rent assessment committee should use the evidence of open market rents wherever they can provide some assistance.
