520 _aChD, 14 January 1994. In 1974 an order under Leasehold Reform Act 1967 s19 approved a scheme conferring powers of management on the applicant estate governors (G). This scheme prohibited erection of any new structure, visible at ground level, beyond the boundaries of an enfranchised property without prior approval of G. In 1992 owners of a detached house (W) sought G's consent to construct a 2-car detached garage at the front of the property. At arbitration it was held that the garage would be visible beyond the property boundaries but that G's decision was unreasonable. G appealed on the grounds that the arbitrator had applied the wrong test in making his award. Application allowed, award remitted to the arbitrator on the grounds that they were not entitled to hold on the reasonableness of the case.
