Various structures were erected within the curtilage of the church. The planning authority served enforcement notices requiring that the partially completed structure, which was of substantial size and had a marked visual impact be dismantled and removed from the site. The appellant`s appeal against the enforcement notice was dismissed by the reporter of the SoS. The appellant appealed specifying six grounds, including the contention that the reporter wrongly determined that a free-standing structure is subject to listed building control. The court refused all grounds of appeal.
