520 _a"Dolgellau Golf Club v Hett" CA 3 April 1998. The appellant held a tenancy of land on which it operated a golf club. Prior to the expiration of the term of the tenancy, they served a request on the landlord seeking a new tenancy under Landlord and Tenant Act 1954 s26. The landlord served a counternotice opposing the new tenancy on the grounds provided by s30 of the Act. At the county court hearing the landlord relied on s30(9) of the Act, that he intended to occupy the premises for the purpose of establishing a proprietary golf club. Held; the appeal was dismissed. Whether the landlord established his intention to occupy the land for the purpose of running a golf club was the issue not whether the scheme was practical.
