Planning permission for a retail, restaurant and car parking development on the fringe of Bridgewater town centre was refused as it was not in accordance with the local development plan. The inspector identified that to permit the development would pre-empt decisions on shopping policy that ought to be dealt with by a review of the local plan. B claimed that this issue of prematurity was not raised at inquiry and that they therefore never had chance to address the issue. B further claimed that it was not correct practice to base a decision on prematurity. B`s appeal allowed.
